Publishers agreements often reside under the guise of 'Permission to Reproduce'.

Although most of them are quite fair; there are a small number which are simply designed to strip away your own

Terms & Conditions regarding the Reproduction of Photographs.

One persistant form has appeared [below] in which the photographer or supplier of images is given no choice whatever!

IF YOU SIGN - YOU ACCEPT THEIR TERMS!

IF YOU DO NOT SIGN - YOU ACCEPT THEIR TERMS!

The above ringed phrase means that publishers using this form are trying to force their Terms & Conditions upon you!

Whether you sign or do not sign the Publisher think you have no option but to accept whatever Terms they dictate!

DO NOT SIGN THIS FORM!

RETURN IT TO THE PUBLISHER WITH THE OFFENDING PHRASE

CROSSED OUT AND MARKED "UNACCEPTABLE"! THEN WRITE -

PHOTOGRAPHS ARE USED ON [YOUR NAME] TERMS AND CONDITIONS ONLY WHICH MAY NOT BE SUPERSEDED AND SHALL HAVE CONTINUING PRECEDENCE OVER ALL OTHER TERMS AND CONDITIONS ABSOLUTELY HOWSOEVER AND WHENSOEVER REFERRED TO.

SIGN AND DATE IT AND RETURN THE FORM WITH

YOUR INVOICE AND YOUR OWN TERMS AND CONDITIONS.

If the publisher refuses to pay until you have signed, simply inform them that use of your

photographs without payment for usage on the Terms & Conditions that YOU trade under is a

BREACH OF COPYRIGHT!

and that you are not prepared to let the matter rest there.

THEY ARE YOUR PHOTOGRAPHS!

YOU MAKE THE RULES GOVERNING THEIR USE!
